Terms of Service

We tried our best to make our Terms of Service easy to understand.
1. Definitions
- Platform: The services provided by Small Transfers, including the website and associated applications.
- Service: A product or service provided by a Merchant to a Customer, where payment for this service is facilitated by the Platform.
- Merchant: A user of the Platform who provides one or more Service to Customers, where payment for these Services is facilitated by the Platform.
- Customer: A user of the Platform who uses one or more Services provided by Merchants, where payment for these Services is facilitated by the Platform.
- Merchant Charges: The charges that Merchants added to a Customer's account.
- Merchant Fee: The fee that charge Merchants. It is equal to (3% × Merchant Charges).
- Transfer: An automatic transfer of funds that the Platform makes to a Merchant from a Customer Payment. The amount equals the unpaid Merchant Charges that the Merchant previously added to the Customer's account minus the Merchant Fee.
- Amount Owed: The sum of all Merchant Charges minus the sum of all Payment Amounts for a particular Customer at some point in time. Note that this amount can be negative; see Credit for how this can happen.
- Amount Owed Limit: The maximum amount that a Customer can owe. It starts low (1.00 USD) when a Customer creates their account, and increases with successful payments.
- Payment Method: A payment method, e.g. a credit card, is a way for a Customer to pay for a Service. Customers can provide a payment method that supports the 3D Secure protocol.
- Payment Provider: The payment provider is the external service that the Platform uses to charge Payment Methods. Our payment provider is Stripe.
- Minimum Payment Amount: The minimum amount that the Payment Provider allows us to charge a Customer. This amount is 0.50 USD.
- Default Payment Amount: The amount we normally charge Customers. It equals (Amount Owed + Credit Used + Payment Processing Fee) when the payment is initiated.
- Payment Amount: The amount charged to a Customer's Payment Method.
- Credit: When the Default Payment Amount is lower than the Minimum Payment Amount, we charge the Minimum Payment Amount and add credit to the Customer's account for the difference. Note that this is only due to the limitations of the Payment Provider. Such credit cannot be refunded, transferred or used for anything other than paying future Merchant Charges.
- Credit Added: Credit that has been added to a Customer's account when the Default Payment Amount is below the Minimum Payment Amount.
- Credit Used: Credit that was previously added to a Customer's account and is now being used to lower the Amount Owed.
- Payment Processing Fee: For Customer payments, we charge the Payment Processing Fee, which is used to pay for the fees charged by the Payment Provider. This fee is 4% × Payment Amount + 0.30 USD.
2. Acceptance
2.1. By using our Platform, you agree to these Terms of Service.
3. Registration
3.1. You agree to provide accurate, up-to-date, and complete information during the registration process, and to update such information to keep it accurate, up-to-date, and complete.
4. Legal & Fair Usage
4.1. You agree not to exploit or misuse the Platform. This includes, but is not limited to:
- Using the Platform for any unlawful or fraudulent activities, including but not limited to money laundering, terrorist financing, or deceptive commercial practices.
- Attempting to gain unauthorized access to another user's account or personal information.
- Creating multiple accounts to abuse promotional offers provided by the Platform.
- Interfering with or attempting to disrupt the proper functioning of the Platform, including any technological measures we employ to control access or data.
- Using the Platform in any manner that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the services, or that could damage, disable, overburden, or impair the functioning of the Platform in any manner.
5. Payments and Fees
5.1. Payments Methods: Customers must add a valid Payment Method before using the Platform.
5.2. Payment Times: Customers are charged every month and when their Amount Owed reaches their Amount Owed Limit.
5.3. Transfer Times: Each time a Customer makes a successful payment, the Platform immediately initiates Transfers to the relevant Merchants.
5.4. Taxes: Merchants are responsible for determining, tracking, and handling all applicable taxes, including sales tax and VAT, associated with their services.
5.5. Fee Changes: We reserve the right to change our fees. In such cases, we will make every effort to provide sufficient notice and be both fair and transparent.

7. Termination
7.1. You can request to close your account at any time.
7.2. We reserve the right to close your account if you violate these Terms of Service.
7.3. If a Customer's Amount Owed is positive, the Customer must make a payment of the Payment Amount before their account can be closed. If a Customer's Amount Owed is negative, we will not refund the Customer's Credit.
8. Limitation of Liability
8.1. To the extent allowed by law, we are not responsible for:
- Losses not directly caused by our actions.
- Losses or damages that neither we nor you could have predicted when you agreed to these terms.
- Any harm resulting from unauthorized access, alteration, or use of your personal data by third parties, if such access occurs through no fault of ours.
- Issues or failures directly attributable to external services we use, such as payment processors or banks.
9. Governing Law
9.1. These Terms of Service are governed by the laws of the United Kingdom.
9.2. If any provision of these Terms of Service is held to be invalid, illegal, or unenforceable, the remaining provisions of these Terms of Service will continue in full force and effect, and the invalid, illegal, or unenforceable provision will be amended to achieve as closely as possible the effect of the original term.
9.3. Any disputes arising out of or relating to the Platform will be subject to the jurisdiction of the courts of the United Kingdom.
10. Updates
10.1. We may update these Terms of Service from time to time. Any significant changes will be communicated to you.
